The year 2018 has marked a series of event, challenges, but also achievements for the Remote Gambling Organizers’ Association (AOJND). As such, at the end of the year, AOJND has succeeded in impose itself in the associative field as the sole profile association which reunites the majority of online gambling.
The mission of the Remote Gambling Organizers’ Association for the year 2018 had the purpose of connecting and bringing together the remote gambling organizers and the State institutions, making available to their members tools through which they can professionally manifest on the Romanian gambling market.
The promotion and protection of Romania’s remote gambling operators’ rights and interests; the creation of a competitive environment on the remote gambling company’s market; supporting the Authorities in perfecting regulatory framework, but also the development of the field in a responsible framework, to the benefit of the public and of the Romanian economy are just some of the priorities on the AOJND 2018 agenda.
Up to this moment, the Remote Gambling Organizers’ Association continues the undertakings it has begun this year with regards to the issues of remote gambling.
As such, until now, the following issues can be found on the Remote Gambling Organizers’ Association agenda:
DEBATE WITHIN THE PARLIAMENTARY COMMISSIONS WITH REGARDS TO THE TAXATION OF ONLINE GAMBLING
The Association has been present at all the Chamber of Deputies’ Budget-Finance Commission’s session, where legislative changes were discussed with regards to the draft law to refuse Government Emergency Ordinance no. 42/2015 for the amendment and completion of certain normative laws in the field of gambling.
AOJND, represented by Mrs President Nestor, has defended the interests of the association members by taking the floor several times during the Commissions, thus showing that there is an imposed control upon operators, millions of euros being collected from the operators’ gains each year in Romania.
Concurrently, Mrs. Nestor has argued the idea according to which the authorization tax is the equivalent of a corporate tax, therefore, the Romanian state, by imposing the taxation of bonuses to which a 16% tax is added, makes the tax payed by online gambling operators today reach at least 20%. Another opinion belonging to the Association President showed that a greater taxation would send operators on the black and gray markets, as per the example of other European States.
LEGISLATIVE AMENDMENTS WHICH REGARD THE INSTRUCTIONS / GEO 77/2009 – Order of the President REGARDING THE REGULATED BONUSES AND PROMOTIONS
With regards to the amendment of the legislation regarding the regulated bonuses and promotions, AOJND requested, within the last Advisory Councils for Clarification, that an Order be issued and that all law articles regarding bonuses and promotions be analyzed as to make a strict delimitation between advice and notification and as to eliminate the common issue among association member with regards to what bonus and promotion mean for a good practice and with the purpose of eliminating confusions created by the two terms. In this respect, the AOJND shall receive the draft order for consultation.
LEGISLATIVE AMENDMENTS OF THE AUDIOVISUAL CONTENT REGULATION CODE WITH REGARDS TO TV ADVERTISING OF GAMBLING PUBLISHED BY THE CNA
AOJND has actively participated to all sessions of the National Audiovisual Council (CNA), proposing amendments with the purpose of allowing Gambling advertising before 23:00 and in the context of live-feed sports events.
The President, Mrs. Odeta Nestor, has taken the floor during these session, supporting the amendments proposed by the AOJND, following that she inform the members with regards to the National Audiovisual Council’s decision regarding the approval of advertising during sports events with clear delimitations of the transmission times – before and after the sports event. Mrs. President has specified that she shall request clarifications in this respect from the Competition Council until the publishing of the law.
REPRESENTATION OF AOJND MEMBERS within the Advisory Council of the ONJN
The Remote Gambling Organizers’ Association is represented by Mrs. President Nestor within the Advisory Council of the National Office for Gambling (ONJN), so that, each time its members have a proposal or wish to draw attention to an issue, they will have a word within the Council through the AOJND.
ROUND TABLE REGARDING THE CURRENT ISSUES OF THE ROMANIAN GAMBLING
In July this year, AOJND organized an event in the form of a round table with regards to the current issues of the Romanian gambling to which participated both the Romanian State authorities represented by the Competition Council, National Anti-Fraud Agency, National Office for Gambling, National Audiovisual Council, National Office for the Prevention and Fight against Money Laundering, as well as gambling operators. The meeting marked an extremely important point in the bilateral relations between the operators and the Romanian State and paved the way for a dialog that would allow for a better operation and regulation in this industry.
The RESPONSIBLE GAME Campaign
In October this year, within the EUROMAT Executive Committee, AOJND joined the efforts of the RESPONSIBLE GAME association, program dedicated to all persons who suffer from gambling issues and which offers a real help to such individuals. This program has as purpose the prevention, identification and assistance of players with gambling issues and proposes and efficient intervention program, not only for the persons which are affected by this phenomenon, but also for their families.
