In the current context of unlocking the online gambling market, when, after a long stay in the „waiting room”, organizers (which applied and also met the requirements imposed by the National Office for gaming) were granted, for the first time, the right to lawfully operate in Romania, the adoption of methodological rules that are in trend with the new reality of the market is a must.

Thus, in a moment of respite that followed the 10th of November (the deadline for the submission, by economic operators which have performed in the past remote gambling  activities in Romania without holding a license and an authorisation issued in accordance with the Romanian law, of supporting documents and for the payment of the amounts owed to the Romanian state for operations starting from December 24, 2010, in order for them to be able to benefit from the amnesty provided by law), the National Gambling Office (NOG) published on its official website the draft of the Decision approving the Methodological Guidelines for the implementation of the Government Emergency Ordinance No. 77/2009 on the organisation and operation of games of chance and the amendment of some normative acts„.

As you probably know, this draft normative act, was notified to the European Commission on April 09, 2015, initially had a standstill period of three months (until July 10, 2015) – period allowing the Commission and the other Member States to examine the notified text and to respond appropriately and during which the Member State which made the notification cannot adopt the technical regulation – which was extended by another month, such finally expiring on August 10, 2015, when the secondary legislation has gone back on the agenda of NOG .

This draft legal act has undergone a few changes from the version notified to the Commission to the one published by NOG which we now understand such would be the final version.

As the ink has barely dried on the decisions issued by NOG granting to remote gambling operators (which have submitted a compliant application) the interim right to organize and operate remote gambling in Romania, we will hereby discuss about major amendments of the secondary legislation, occurred between the notified version to the European Commission and the version published by NOG, with respect to the online gambling sector.

We present below some of the main changes:

–          the definition of the safe server was amended as follows: clarifications were brought regarding the category of players for whom data will be stored on the server, stating that it refers to Romanian players or players who use a Romanian IP” (the previous version talked about the players who are registered and take part in online games of chance authorised in Romania); the amount of data which must be stored on the safe server is extended in the sense that the information is to include not only data regarding Romanian players, but also data regarding the games carried out and financial transactions related to remote games of chance authorized in Romania; moreover, the safe server must be designed in such manner that the remote gambling organizer licensed in Romania is unable to perform any data changes;

–          it is clarified that the safe server, as well as the mirror server, will be located either at the NOG’s premises or in a data centre, subject to obtaining a second class license (as against the previous version which stated that the servers in question were located “in the territory of Romania”);

–          a new requirement on bonuses was introduced for remote gambling operators in the sense that the bonuses granted will be highlighted in a distinctive manner in the accountancy of the operator of games of chance and will be introduced, based on their use, in the income obtained from the games of chance of the licensed operator and will be treated as participation fee to the game;

–          the deadline for the remote gambling operator to verify the authenticity of the data provided by the players is extended from 15 calendar days to 30 calendar days as of registration;

–          the amounts of money deposited by the self-excluded or undesirable players or the players who did not complete the KYC process will be transferred to the state budget until the 25th of the following month (the previous legislation did not regulate any deadline, thus the new provision is a clarification);

–          as regards the obligation of organizers to keep records, organised per tax domicile, regardless of the number of premises where the activity is carried out, besides the activities for which they have been authorised and the corresponding financial results, there were included also the offers/ promotions addressed to the game participants;

–          a new condition is stipulated for granting the authorization for operating remote games of chance,  namely the organizer must carry out the gaming activities not only on the same platform (as regulated in the initial version), but also by using one internet domain name only;

–          the centralized statement which persons applying for a licence and authorisation for remote games of chance must submit to the Monitoring Committee of the National Gambling Office, at the time of their first authorisation, must include information not only on Romanian players (as regulated in the initial version), but also on any players from Romania;

–          a 24 hours timeframe in which the remote gambling operators can transmit the information of the central computer system requested by the NOG is stipulated;

–          the new version expressly regulates that the right of organizing and exploiting remote games of chance, given by the Monitoring Committee of the NOG based on paragraph (7) of art. II from the law 124/2015 regarding the approval of the Government’s Emergency Ordinance no. 92/2014 for the settlement of some fiscal-budgetary measures and the modification of some normative acts, until the date of 31 December 2015, is valid for a period of one year from the date of granting, subject to compliance to the legal provisions in force.

It seems that in the very near future we could talk about a comprehensive legal framework, rooted in the current reality of gambling in Romania, and which, at least at first glance, gives less room to interpretation and discussions.

În contextul actual al deblocării pieței jocurilor de noroc online, când, după o perioadă îndelungată în “sala de așteptare”, organizatorilor (care au aplicat și care au îndeplinit cerințele impuse de Oficiul Național pentru Jocuri de Noroc) li s-a acordat pentru prima dată dreptul de a opera în mod legal în România, adoptarea unor norme metodologice care să fie în tendință cu noua realitate a pieței este o necesitate.

Astfel, într-un moment de respiro care a urmat termenului de 10 septembrie (termenul limită pentru depunerea de către operatorii economici, care au desfășurat în trecut activități de jocuri de noroc la distanță în România fără deținerea unei licențe și a unei autorizații eliberate în conformitate cu legislația din România, a documentelor justificative și a plății sumelor datorate statului român pentru operarea începând cu 24 decembrie 2010, pentru ca aceștia să se încadreze în perioada de amnistie prevăzută de lege), Oficiul Național pentru Jocuri de Noroc (ONJN) a publicat pe website-ul oficial proiectul de “Hotărâre pentru aprobarea Normelor metodologice de punere în aplicare a Ordonanţei de urgenţă nr. 77/2009 privind organizarea şi exploatarea jocurilor de noroc și modificarea unor acte normative”.

După cum probabil știți, acest proiect de act normativ, notificat Comisiei Europene în data de 09.04.2015, a avut inițial o perioadă de aşteptare de trei luni (până pe data de 10.07.2015) – perioadă care permite Comisiei şi celorlalte state membre să examineze textul notificat şi să răspundă în mod adecvat și în care statul în cauză nu poate adopta reglementarea tehnică în cauză – care a fost prelungită cu încă o lună, aceasta luând sfârșit la data de 10.08.2015, când legislația secundară a intrat din nou pe agenda ONJN.

Proiectul de act normativ a suferit câteva modificări între varianta notificată Comisiei Europene și cea publicată de către ONJN, despre care înțelegem acum că ar fi varianta finală.

Pentru că încă nu s-a uscat cerneala pe deciziile emise de ONJN prin care se acordă operatorilor de jocuri de noroc la distanță (care au depus o aplicație conformă) dreptul provizoriu de a organiza și exploata jocuri de noroc la distanță în România, vom discuta în cele ce urmează despre principalele modificări intervenite în legislația secundară, între varianta notificată la Comisia Europeană și cea publicată de ONJN, în ceea ce privește sectorul jocurilor de noroc online.

Redăm mai jos câteva dintre principalele modificări :

–          definiția serverului de siguranță a fost schimbată după cum urmează: au fost aduse clarificări cu privire la categoria de jucători pentru care vor fi stocate date în acest server, precizându-se că este vorba despre „jucătorii români sau care utilizează IP de România” (față de versiunea anterioară în care se făcea vorbire despre „jucătorii înregistraţi şi participanţi la jocurile de noroc online autorizate în România”); cantitatea de date care trebuie să fie stocată pe serverul de siguranță este extinsă, în sensul că informațiile trebuie să includă nu numai date referitoare la jucătorii români, dar și date cu privire la jocurile desfășurate și tranzacțiile financiare aferente jocurilor de noroc la distanță autorizate în România; în plus, serverul de siguranță trebuie să fie proiectat în așa fel încât organizatorul de jocuri de noroc online licenţiat în România să nu aibă posibilitatea de a mai efectua orice modificări de date;

–          se clarifică faptul că serverul de siguranță, precum și serverul în oglindă vor fi amplasate fie la sediul ONJN, fie  într-un centru de date sub rezerva obținerii unei licențe clasa a II-a (față de versiunea anterioară în care se preciza că serverele în discuție se situau “pe teritoriul României”);

–          introducerea unei noi cerințe pentru operatorii de jocuri de noroc la distanță cu privire la bonusuri în sensul că bonusurile acordate vor fi evidenţiate în mod distinct în contabilitatea operatorului de jocuri de noroc la distanță și vor fi introduse, pe măsura utilizăriii acestora, în venitul din jocurile de noroc ale operatorului licenţiat și vor fi asimilate taxei de participare la joc;

–          termenul pentru verificarea de către organizatorul de jocuri de noroc la distanță a autenticității datelor furnizate de către jucători se extinde de la 15 zile calendaristice la 30 de zile calendaristice de la înregistrare;

–          sumele de bani depuse de jucătorii autoexcluși sau indezirabili sau de către cei care nu au confirmat autenticitatea datelor furnizate în termen vor fi transferate la bugetul de stat până la data de 25 a lunii următoare (versiunea anterioară nu reglementa niciun termen, astfel că noua versiune prevede această clarificare);

–          cu privire la obligativitatea organizatorilor de a ține o evidență organizată la nivelul domiciliului fiscal, indiferent de numărul de locaţii în care se desfăşoară activitatea, pe lângă activitățile de jocuri de noroc pentru care au fost autorizaţi și a rezultatelor financiare aferente, au fost incluse și ofertele/promoțiile adresate participanților la joc;

–          este prevăzută o nouă condiție pentru acordarea autorizației de funcționare pentru jocuri de noroc la distanță, respectiv organizatorul trebuie să desfășoare activitățile de jocuri de noroc la distanță nu numai pe aceeași platformă (astfel cum era reglementat în versiunea inițială), dar, de asemenea, prin intermediul unui singur nume de domeniu;

–          situația centralizată pe care solicitantul de licenţă şi autorizaţie pentru jocurile de noroc la distanță are obligaţia să o prezinte Comitetului de Supraveghere al Oficiului Naţional pentru Jocuri de Noroc, la momentul primei autorizări, trebuie să includă informații nu doar despre jucătorii de cetățenie română (astfel cum cum se prevedea în versiunea inițială), dar, de asemenea despre orice jucători din România;

–          se introduce un interval de timp de 24 de ore în care organizatorii de jocuri de noroc la distanță pot transmite datele solicitate expres de Oficiul Naţional pentru Jocuri de Noroc din sistemul informatic central;

–          în noua versiune se prevede în mod expres că dreptul de organizare şi exploatare a jocurilor de noroc la distanţă, acordat de Comitetul de Supraveghere al ONJN în temeiul alin. (7) al art.II din Legea 124/2015 privind aprobarea Ordonanţei de urgenţă a Guvernului nr. 92/2014 pentru reglementarea unor măsuri fiscal-bugetare şi modificarea unor acte normative, până la data de 31 decembrie 2015, este valabil pentru o perioadă de un an de la data acordării cu respectarea prevederilor legale în vigoare.

Pare că în viitorul foarte apropiat vom putea vorbi despre un cadru legislativ complet, ancorat în realitatea actuală a jocurilor de noroc în România, și care, cel puțin la o primă vedere, lasă loc pentru mai puține interpretări și discuții.
